These Terms of Use ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Services") operated by Wave3 Digital Trust LLC ("Wave3," "we," "us," or "our"), including but not limited to chat-with-impossible.com, chatpack.studio, and all related chat-with-X domain properties. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

2. Description of Services

The Services include AI-assisted tools for problem reframing (Impossibility Engineering), content submission for editorial review, and related informational and educational features. Some Services may include AI-powered chat functionality.

3. AI-Generated Content Disclaimer

Important: Portions of the Services use artificial intelligence ("AI") to generate responses and content. AI-generated outputs are provided for informational and educational purposes only and do not constitute professional advice of any kind, including but not limited to legal, financial, medical, engineering, security, or compliance advice. You should not rely on AI-generated content as a substitute for professional judgment. Wave3 makes no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.

4. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Submit or transmit content that is defamatory, obscene, threatening, or that infringes the rights of any third party.
  • Attempt to gain unauthorized access to the Services or any related systems.
  • Use the Services to generate content intended to deceive, defraud, or mislead others.
  • Reverse engineer, decompile, or disassemble any portion of the Services.
  • Use automated tools (bots, scrapers) to access the Services without our express written consent.

5. User-Submitted Content

When you submit content through the Services — including but not limited to story submissions, chat interactions, feedback, or any other materials ("User Content") — you retain ownership of your original content. However, by submitting User Content, you grant Wave3 Digital Trust LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Services, research, publications, and related materials.

For story submissions intended for the book Impossible and related publications, a separate publishing release is presented at the time of submission. That release governs the additional rights granted for editorial use.

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, software, and the "Impossibility Engineering" methodology — are the exclusive property of Wave3 Digital Trust LLC or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WAVE3 DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVE3 DIGITAL TRUST LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless Wave3 Digital Trust LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

10. Third-Party Links and Services

The Services may contain links to third-party websites or services. Wave3 is not responsible for the content, policies, or practices of any third-party sites. Access to third-party sites is at your own risk.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms that by their nature should survive will survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.
